The Measures of Handan Municipality
on the Administration of Urban River Courses which was
adopted on the 14th executive meeting of Handan Municipal People’s Government
on November 12, 2017, is hereby promulgated and shall come into force on February
1, 2018.

The Measures of
Handan Municipality on the Administration of Urban River Courses
第一條 為加強河道管理，保障防洪排澇工程安全，維護河道衛(wèi)生環(huán)境，發(fā)揮河道綜合效益，根據(jù)《中華人民共和國水法》《中華人民共和國防洪法》《中華人民共和國河道管理條例》等有關(guān)法律、法規(guī)，結(jié)合本市實際，制定本辦法。
Article 1 In the view of strengthening channel management, ensuring the
safety of projects like flood control and drainage management, maintaining the
cleanliness of the river, and giving full play to the comprehensive benefit of
the river courses, these measures are formulated in accordance with the
relevant rules and regulations, for instance, The Water Act of People’s
Republic of China, The Flood Control Law of People’s Republic of China,
Regulations of the People's Republic of China on the Management of river
courses, in the light of current circumstances of this municipality.
第二條 市、縣（市、區(qū)）政府所在地的河道、溝渠、湖泊及其附屬設(shè)施的整治、利用、保護、開發(fā)和與之相關(guān)的管理與監(jiān)督，適用于本辦法。
Article 2 These measures apply to regulation, utilization, protection,
development and related management and supervision of rivers, trenches, lakes
and their affiliated facilities where the governments of Handan municipality
and counties (the city and districts) locate.
第三條 城市河道管理實行市、縣（市、區(qū)）分級管理，群眾參與、社會監(jiān)督相結(jié)合的原則。
Article 3 The urban river course management will take the principle of
combining administration by different levels of municipality
and counties (the city and districts), mass participation and social
supervision.
Article 4 Every unit or individual has the obligation to protect the
environment, cleanness and engineering safety of the urban river courses, and
has the right to dissuade and report the acts of endangering the river courses'
water environment, and destroying the river courses as well as its ancillary
facilities.
第五條 水利、城市管理、建設(shè)、環(huán)境保護、規(guī)劃、農(nóng)牧等有關(guān)部門按照各自的職責(zé)分工，共同做好城市河道管理工作。
Article 5 The relevant departments, like water conservancy department,
urban management department, construction department, environmental protection
department, urban planning department, agriculture and animal husbandry department,
should work together to realize a good urban river courses management in
accordance with their respective responsibilities and functions.
第六條 城市河道環(huán)境綜合整治按照市、縣（市、區(qū)）、鄉(xiāng)（鎮(zhèn)）河長制工作方案，實行河長制管理。
Article 6 The urban river courses comprehensive management should be carried
out sticking to the management system of the “River Chiefs” according to the
corresponding River Chief work program at
level of the municipality and counties (the city and districts).
第七條 各級河長在職責(zé)范圍內(nèi)對城市河道管理工作負責(zé)。
Article 7 The River Chiefs at all levels should take the responsibility for
the urban river course management within its corresponding scope of official
duty.
市級總河長對全市河湖管理保護負總責(zé),對全市河長制工作進行總督導(dǎo)、總調(diào)度。
The river chief at Municipal
level takes the overall responsibility for management and protection of rivers
and lakes in Handan City and overall responsibility for supervision and
dispatching of River Chief management system in Handan city.
The river chief at municipal
level is responsible for guiding and coordinating the protection and management
of rivers and lakes, and supervising subordinate departments and other relevant
municipal departments to perform their duties in solving the major problems of
river and lake management coordination.
縣級總河長對本行政區(qū)域內(nèi)河湖管理保護負總責(zé)。重點對河湖水資源保護、水域岸線管理、水污染防治、水環(huán)境治理、水生態(tài)修復(fù)、河道防洪保安、執(zhí)法監(jiān)管等工作進行安排部署、組織協(xié)調(diào)、督導(dǎo)調(diào)度，及時研究解決河湖管理重點難點問題。
The river chief at county level
takes the overall responsibility of the river and lake management in its
administrative region. The focus of work should be arranging, organizing,
coordinating and dispatching the work of protection of rivers and lakes, water
resources, water coastline management, water pollution prevention and control,
water environment control, water ecological restoration, river courses flood
control and security, and related law enforcement supervision. The key and
difficult problems of river and lake management have to be studied and solved
in time.
縣、鄉(xiāng)兩級河長對分管的河湖管理保護工作負領(lǐng)導(dǎo)責(zé)任。檢查督導(dǎo)有關(guān)部門或村集體經(jīng)濟組織履行職責(zé)；組織協(xié)調(diào)上下游、左右岸進行聯(lián)防聯(lián)控；組織對超標排污、侵占河道、圍墾河湖、傾倒垃圾、非法采砂、電毒炸魚等突出問題依法進行清理整治；協(xié)調(diào)處置涉水突發(fā)問題；對河湖管理績效目標任務(wù)完成情況進行評估。
The river chiefs at the level
of county and township take the responsibility for guiding leading the
management and protection of its assigned rivers and lakes. Their duties
include: To supervise and urge the departments concerned or the village
collective economic organizations to perform their duties; To organize and
coordinate the upstream and downstream, as well as both sides of the river to
conduct preventive management and control management jointly; To tackle with
the difficult issues of river management, like pollution discharging at
exceeding standard, encroachment of river courses, reclamation of river and
lake, dumping rubbish, illegal sand mining, and the use of electricity, poisons,
explosives and any other means in fishing that impairs the fishery resources;
To coordinate and deal with the sudden problems relating to water; Evaluate the
goal accomplishment in river and lake management.
第八條 河道水面的環(huán)境衛(wèi)生由市、縣（市、區(qū)）政府確定的部門按照相應(yīng)的職能分工，各司其職。
Article 8 The departments determined by the governments of the
municipalities and counties (the city and districts) should bear and perform
their own responsibilities for keeping and managing environment and sanitation
of the water surface of the river courses according to the corresponding
administrative function division.
市城市河道兩側(cè)綠地的環(huán)境衛(wèi)生由市城市管理行政主管部門負責(zé)；綠地以外的環(huán)境衛(wèi)生由區(qū)政府負責(zé)。
The Municipal Administration
Department in charge of urban administration is responsible for keeping and
managing the environment and sanitation of green space on both sides of urban
river courses. The government at district level will be responsible for the environment and sanitation
of areas outside the green space.
縣（市、區(qū)）城市管理行政主管部門根據(jù)職責(zé)分工,負責(zé)河道兩岸沿線的環(huán)境衛(wèi)生的清掃與處置，在所轄地段的沿河鄉(xiāng)村、社區(qū)設(shè)置垃圾收集容器，做好清運、管理工作。垃圾雜物應(yīng)及時清運中轉(zhuǎn)到附近的垃圾站，不得隨意傾倒、焚燒。
The administrative departments in charge of urban management in
counties (the city and districts) will be responsible for managing environment and sanitation along
the banks of the river, for setting up a garbage collection container in the
villages, communities along the river in the area under its jurisdiction, and
for garbage clearance, treatment and management. In addition, rubbish should be
cleaned and transferred to nearby station in time, which is allowed to be
dumped or burn at will.
Article 9 The dumping of garbage is strictly prohibited within the
management area of the river courses.
市、縣（市、區(qū)）建設(shè)行政主管部門應(yīng)當加強施工場地監(jiān)管，無建筑垃圾處置手續(xù)的車輛，不得進出施工場地。
The construction administrative
department at the level of municipality and counties (the city and districts)
should strengthen the supervision of construction sites. Those vehicles without
proper construction waste treatment procedures are not allowed to get in or out
the construction site.
市、縣（市、區(qū)）城市管理行政主管部門負責(zé)查處向河道傾倒建筑垃圾和生活垃圾的行為。
The urban management department
at the level of municipality and counties (the city and districts) should be
responsible for investigating and punishing the behaviors and violators that
dumped construction waste and domestic waste into the river.
第十條 河道主管部門、城市排水主管部門應(yīng)當按照各自職責(zé)分工，在汛期前組織對所管轄的有調(diào)蓄雨水、排澇作用的河道、湖塘洼淀、溝汊水渠以及城區(qū)內(nèi)的排水設(shè)施進行清淤排障，充分發(fā)揮其調(diào)蓄洪水和排除內(nèi)澇的功能。
Article 10 The administrative department in charge of urban river course
management and urban drainage management should be responsible for clearing the
silt and debugging the river courses, ponds, lakes, ditches, branches, canals
and other urban drainage facility in the regions under jurisdiction before the flood season and be
responsible for giving full play to the function of regulating
flood and eliminating water logging of those water bodies and facilities
mentioned above, in accordance to their respective responsibilities.
第十一條 為保障河道行洪，河道主管部門應(yīng)做好河道內(nèi)船只、皮劃艇投放量規(guī)劃。對經(jīng)海事等部門審查同意投放的船只、皮劃艇，河道主管部門要按照防洪對河段、水位、季節(jié)等要求，合理調(diào)度船只、皮劃艇投放量。
Article 11 In order to guarantee the river courses function of regulating
floods, the administrative department in charge of river courses should plan
the delivery of boats and canoes in the river well. In accordance with the
requirements of flood control, the river, water level and season etc., the
administrative departments in charge of the river courses should reasonably
dispatch the number of boats and canoes, which have been approved by the
maritime departments.
第十二條 在城市河道內(nèi)，禁止垂釣、炸魚、毒魚、電魚，禁止使用漁網(wǎng)、地籠、迷魂陣等手段捕撈水生動物，允許經(jīng)營性垂釣的湖塘除外。
Article 12 In the urban river courses, the use of explosives, poisons,
electricity and any other means in fishing that impairs the fishery resources
is prohibited; the use of nets, cages, traps and any other means in fishing
that impairs aquatic animals is prohibited, except for the lakes and ponds
which allow operational fishing.
第十三條 城市河道管理范圍內(nèi)，禁止下列行為：
Article 13 The following acts are prohibited in the management of
thirteenth urban rivers:
（一）在防汛通道、人行道設(shè)置經(jīng)營攤點；
（1）To set up businesses in the
flood control channel and the sidewalk stalls;
（二）露天燒烤及遺棄雜物；
（2）To barbecue in the outdoor and
throw sundries
（三）破壞沿河市政公用設(shè)施、亮化設(shè)施、沿河護欄、安全警示牌等相關(guān)設(shè)施；
（3）To destroy the municipal public
facilities, lighting facilities, river guardrails, safety warning signs and
other related facilities along the river.
（四）向河道管理范圍內(nèi)傾倒垃圾、渣土、枝葉或者其他廢棄物；
（4）To dump garbage, residue,
branches and leaves or other wastes into the areas within the river course management scope.
（五）破壞或采摘河內(nèi)及兩岸觀賞類植物；
（5）To destruct or pluck ornamental
plants in the river or on both river sides.
（六）未經(jīng)批準擅自取水；
（6）To consume water from river
without approval.
（七）擅自建設(shè)建筑物、構(gòu)筑物；
（7）To construct any buildings in
an unauthorized manner.
（八）擅自新建、改建和擴大入河排污口;
（8）To construct, reconstruct and
expand sewage outlets into the river in an unauthorized manner.
（九）法律、法規(guī)、規(guī)章規(guī)定的其他違法行為。
（9）Any other illegal acts
prescribed by laws, and regulations.
第十四條 違反本辦法第十二條規(guī)定，在城市河道內(nèi)垂釣的，由河道主管部門責(zé)令其停止違法行為，處50元以上1000元以下罰款。
Article 14 For those who violate the Article 12 of this provision and fish
in the urban river courses, they will be ordered to stop illegal acts and be
imposed a fine of more than 50 Chinese Renminbi Yuan (hereinafter referred to as “CNY”) and less than 1000 CNY by the
river management department.
違反本辦法第十二條規(guī)定，在城市河道內(nèi)炸魚、毒魚、電魚，使用禁止的漁網(wǎng)、地籠、迷魂陣等手段捕撈水生動物的，由農(nóng)牧行政主管部門依據(jù)《中華人民共和國漁業(yè)法》第三十八條和《中華人民共和國漁業(yè)法實施細則》第二十九條規(guī)定，責(zé)令其停止違法行為，沒收漁具、漁獲物和違法所得，并處50元以上5000元以下罰款。
For those who violate the Article 12 of this provision, hurt
fishes and use nets, cages, traps and other means to prohibit fishing of
aquatic animal, they will be ordered to stop illegal acts and imposed a fine of
more than 50 CNY and less than 5000 CNY with confiscation of fishing gear,
catch and illegal income, by the administrative department in charge of
agriculture and animal husbandry according to the Article 38 of Law of the
People's Republic of China on Fishery and Article 29 of Detailed Rules for the
Implementation of the Law of the People's Republic of China on Fishery.
第十五條 違反本辦法第十三條規(guī)定，按下列規(guī)定依法處理：
Article 15 For those who
violate Article 13 of this provision, they will be punished according to the
following regulations:
（一）違反本辦法第十三條第一項、第二項、第三項規(guī)定的，由有管轄權(quán)的城市管理行政主管部門責(zé)令其停止違法行為，并依據(jù)相關(guān)法律、法規(guī)予以處罰。
（1）For those who violate Article
13(1)(2)&(3),
they will be ordered to stop the illegal acts and be punished in accordance
with the relevant laws and regulations by the administrative department in
charge of urban administration with jurisdiction.
（二）違反本辦法第十三條第四項規(guī)定，由城市管理行政主管部門依據(jù)《中華人民共和國河道管理條例》第四十四條第一項規(guī)定，責(zé)令其糾正違法行為，采取補救措施，可以并處100元以上10000元以下罰款。
（2）For those who violate Article 13(4), they will be ordered to
correct their illegal acts and take remedial acts, and be imposed a fine of
more than 100 CNY and less than 10000 CNY by the administrative department in
charge of urban administration according to Article 44(1) of the Regulations on
the river courses management of the People's Republic of China.
（三）違反本辦法第十三條第五項規(guī)定，由水行政主管部門責(zé)令停止違法行為，恢復(fù)原貌，情節(jié)較輕的，處100元以上500元以下罰款；情節(jié)嚴重的，賠償損失，并處500元以上10000元以下罰款。
（3）For those who violate Article 13(5), they will be ordered to stop
the illegal acts and restore their original forms. If the cases are less
severe, violators will be imposed a fine of more than 100 CNY and less than 500
CNY. If the cases are severe, violators have to compensate for all the loss and
will be imposed a fine of more than 500 CNY and less than 10000 CNY by the
water administration department.
（四）違反本辦法第十三條第六項規(guī)定的，由水行政主管部門依據(jù)《中華人民共和國水法》第六十九條第一項規(guī)定，責(zé)令停止違法行為，限期采取補救措施，處20000元以上100000元以下罰款。
（4）For those who violate Article 13(6), they will be ordered to stop the illegal acts and take remedial
acts within a definite time, and will be imposed a fine of more than 20000 CNY
and less than 100000 CNY by the water administration department according to
Article 69(1) of the Water Act of the People's Republic of China.
（五）違反本辦法第十三條第七項規(guī)定的，由城市管理行政主管部門依據(jù)《中華人民共和國水法》第六十五條第一項規(guī)定責(zé)令停止違法行為，限期拆除違法建筑物、構(gòu)筑物，恢復(fù)原狀；逾期不拆除、不恢復(fù)原狀的，強行拆除，所需費用由違法單位或個人負擔(dān)，并處10000元以上100000元以下罰款。
（5）For those who violate Article 13(7), they will be ordered to stop the illegal acts and to dismantle
illegal buildings, structures and restore their original form within a time
limit by the administrative department in charge of urban management according
to Article 65(1) of the Water Act of the People's Republic of China.
（六）違反本辦法第十三條第八項規(guī)定的，由水行政主管部門依據(jù)《中華人民共和國水法》第六十七條第二款規(guī)定，責(zé)令停止違法行為，限期恢復(fù)原狀，處50000元以上100000元以下罰款。
（6）For those who violate Article 13(8), they will be ordered to stop the illegal acts and to restore
their original forms within a time limit, and be imposed a fine of more than
50000 CNY and less than 100000 CNY by the water administration department
according to the Article 67(2) of the Water Act of the People's Republic of
China.
第十六條 冀南新區(qū)、邯鄲經(jīng)濟技術(shù)開發(fā)區(qū)適用本辦法。
Article 16 The Jinan New Development District and Handan Economic and
Technological Development Zone would apply these provisions.
第十七條 本辦法自2018年2月1日起施行。
Article 17 The measures shall come into force on
February 1, 2018.
